Vaccination, licensing and registration of the animal
Answers
Questions about the animal are on much firmer ground than questions about you.
The distinction
A housing provider may not demand certification or training for an assistance animal, because none exists. That is different from an ordinary legal requirement applying to all animals in the jurisdiction, such as rabies vaccination or a municipal dog licence. Those are not fair housing questions at all.
Generally enforceable
- Proof of rabies vaccination where local law requires it.
- A municipal animal licence where one is required.
- Leash rules in shared areas, applied to everybody.
- Waste rules, applied to everybody.
Generally not
- Certification, registration or training documentation for the animal as an assistance animal.
- A behavioural assessment by a trainer of the provider choosing.
- Pet registration fees applied to an assistance animal, which raise the same contested question as any other animal charge.
- Breed or weight limits applied as pet rules to a granted accommodation.
The test to apply
Is this a requirement of general law or building safety that applies to every animal, or is it a pet policy dressed up? The first is enforceable. The second is the thing the accommodation is an exception to.
Common questions
- Can they require pet insurance?
- Requiring insurance specifically because of an assistance animal is difficult to justify. A renters insurance requirement applied to every tenant is a different thing.
