Emotional support animal letter in California

California

California is one of five states that require a clinical relationship of at least 30 days before an emotional support animal letter can issue. That single rule decides most of what follows, so it is worth reading before you pay anyone.

What changed in 2026, and why it matters in California

On 22 May 2026 HUD permanently rescinded its 2020 assistance animal notice and narrowed its own enforcement to animals individually trained to do work or perform tasks for a person with a disability. That is the Americans with Disabilities Act service animal test, and an emotional support animal does not meet it. A complaint to HUD about a refused emotional support animal is now unlikely to produce a finding of reasonable cause.

Three things survived that change:

  • The Fair Housing Act itself is unchanged. Congress wrote the statute and HUD only changed how it enforces it, so the statutory duty to make reasonable accommodations for people with disabilities still stands.
  • The private right of action is unchanged. A tenant can still sue in state or federal court, and a court interpreting the statute is not bound by an agency's enforcement posture.
  • State law is untouched. HUD has no authority over a state statute, and this is where the protection now mostly lives.

California law

California has its own fair housing statute, the Fair Employment and Housing Act (Cal. Gov. Code § 12955), enforced by the California Civil Rights Department. A state complaint runs on state law, so HUD changing its own enforcement priorities does not decide it.

California also legislated on emotional support animals directly, which most states have not. These are the sections that matter:

  • Cal. Health & Safety Code § 122318: Requires a seller of an emotional support animal certificate, registration, tag or similar product to state in writing that the product does not confer the rights of an assistance animal.
  • Cal. Health & Safety Code § 122319: Sets what a health care practitioner must do before issuing emotional support animal documentation: hold a valid active licence, be licensed in the jurisdiction where the documentation is provided, complete a clinical evaluation, establish a client-provider relationship of at least thirty days, and state the licence type, number, jurisdiction and effective date in the document.
  • Cal. Penal Code § 365.7: Makes it a misdemeanor to knowingly and fraudulently represent oneself as the owner or trainer of a service dog.

The 30-day rule in California

California requires the client-provider relationship to exist for at least 30 days before emotional support animal documentation is issued (Cal. Health & Safety Code § 122319, added by AB 468 (2021)). A letter produced the same day you fill in a questionnaire does not satisfy it, no matter who signs it or what it costs.

AB 468 is the strictest documentation statute in the country. The clinician must hold a California licence and must have had a client-provider relationship for at least thirty days before the documentation issues. A questionnaire answered and a letter returned the same day does not meet it.

This is the single most important thing to know before paying anyone for a California letter, and it is the thing online letter services are least likely to tell you. A document that does not meet Cal. Health & Safety Code § 122319, added by AB 468 (2021) is not documentation a housing provider has to treat as reliable, so the money buys nothing.

Who can write a letter for a California renter

A clinician licensed in California, after a real clinical relationship of at least 30 days. The licence has to be current, and California expects the document to identify it.

A letter that is worth anything names the clinician, their licence type, licence number, the state that issued it and its expiration date, so a housing provider can check the licence against the state board. Anything that arrives as a certificate, a registration, an ID card or a vest is not documentation and no statute treats it as such.

Misrepresentation penalties in California

California has a misrepresentation statute at Cal. Penal Code § 365.7: Misdemeanor: up to six months in jail and a fine of up to $1,000. Read the wording before you worry about it, though. It is a service animal fraud statute, and neither the ADA nor California treats an emotional support animal as a service animal, so it does not reach a person with genuine documentation calling their animal what it is. Sites in this industry quote it at readers anyway.

Checking a letter is real

A California housing provider handed a letter has no register to check it against, which is the reason so much of this market is worthless paper. Every letter issued here carries a six digit ESA ID and a public verification page, so a landlord can confirm the letter is real, current, and issued by a licensed clinician without being shown a single word about anybody's health.

Nobody can tell you from a web page whether you qualify, and any site in California that says everyone does is selling something. An emotional support animal letter rests on a licensed clinician evaluating you and concluding that you have a disability and that the animal helps with it. That review can come back no, and when it does here, the fee is refunded.

Common questions

Is an emotional support animal letter still worth anything in California after the 2026 HUD change?
Yes, and California is better placed than most states for it, because it has its own emotional support animal statute rather than relying on federal enforcement. What changed is the federal complaint route. The Fair Employment and Housing Act and the California sections above are unaffected.
Can I get a same-day emotional support animal letter in California?
Not a lawful one. Cal. Health & Safety Code § 122319, added by AB 468 (2021) requires the client-provider relationship to predate the documentation by 30 days. A service that sells you a letter within the hour is selling a document that does not meet the California standard.
Does a landlord in California have to accept a letter from an online service?
Only if the documentation meets Cal. Health & Safety Code § 122319, added by AB 468 (2021), which most online letters do not. The delivery method is not the problem. The absence of a real clinical relationship is.
Can my California landlord charge a pet deposit for an emotional support animal?
Before May 2026 the answer was a flat no, on HUD's own guidance. That guidance is rescinded. In California the question now turns on the state sections above rather than on HUD. See the pet fee page for the detail.

Starting the 30 days in California

The clock only runs forward, so the useful thing to do today is begin the assessment rather than wait until the letter is needed. A clinician licensed in California reviews it, and the fee is refunded if they decline.
