Terms of Service
Last updated 5 September 2026
These terms are a legal agreement between you and ESA Verified. By submitting an assessment or otherwise using the site, you accept them. If you do not agree, do not use the service. This is a summary in plain language, not legal advice.
Eligibility
You must be at least 18 years old, a resident of the United States, and able to enter a contract. You must use the service for yourself, with truthful information.
What ESA Verified does, and does not do
We connect you with a mental health professional who is licensed in your state, and we host a public register so a housing provider can confirm a letter. The clinician independently reviews your assessment and decides whether an emotional support animal letter is clinically appropriate. We do not practice medicine, we do not influence that decision, and we are not a party to the clinician–client relationship. ESA Verified is not a law firm and does not give legal advice.
The assessment and the review
You complete a structured questionnaire and consent to a licensed clinician reviewing the health-related information in it. The clinician may approve and issue a letter, decline, or ask for more information. A decision is not guaranteed within any particular time, though most are made within a few business days.
Fees, and what you are paying for
Your payment is for the clinical review, not for a letter. If the clinician determines an ESA is not appropriate, no letter is issued and we refund the full fee under our Refund Policy. Once a letter has been issued the review is complete and the fee is non-refundable, except that we will correct and reissue a letter with an error we made at no charge.
Your responsibilities
- Give accurate, complete, and current information.
- Use any letter only for lawful reasonable-accommodation requests for your own assistance animal.
- Do not misrepresent your circumstances, resell or alter a letter, impersonate anyone, or attempt to scrape, overload, or probe the register or the site.
Misrepresentation may result in a declined assessment, a revoked letter, suspension of your access, and no refund.
What an ESA letter is and is not
An ESA letter documents a disability-related need for an assistance animal so you can request a reasonable accommodation. Under the Fair Housing Act, most housing providers must consider such a request. It is not a service-animal certification, confers no public-access rights (stores, restaurants, offices), and does not bind any housing provider or airline. Each makes its own decision, and airline policies for ESAs vary and have narrowed. We do not guarantee that any provider will accept a letter.
The verification register
When a letter is issued to you, we list limited, non-diagnostic details (ESA ID, animal name and species, issue and expiry dates, status) so third parties can confirm it. Submitting an assessment authorizes this listing for any letter issued to you. We may revoke a letter, and update its status in the register, if it was obtained through misrepresentation or must be withdrawn for clinical or legal reasons.
Clinicians
Reviewing clinicians are independent licensed professionals, not our employees. They are responsible for their own licensure, clinical judgment, and records. We may remove a clinician from the network at any time.
Third-party services
Payments are processed by Stripe and the site runs on Cloudflare. Your use of those services through us is also subject to their terms.
Intellectual property
The site, its content, and the ESA Verified name and marks are ours or our licensors'. You may use them only to use the service as intended.
Disclaimers
The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, including that a letter will be accepted by any housing provider or airline, or that the site will be uninterrupted or error-free. Nothing here excludes liability that cannot lawfully be excluded.
Limitation of liability
To the fullest extent permitted by law, ESA Verified will not be liable for indirect, incidental, special, consequential, or punitive damages, or for a housing provider's or airline's accommodation decision. Our total liability for any claim relating to the service is limited to the amount you paid us for the review at issue.
Indemnification
You agree to indemnify ESA Verified against claims arising from your misrepresentation, your misuse of a letter or the site, or your breach of these terms.
Termination
You may stop using the service at any time. We may suspend or end your access if you breach these terms or misuse the service. Sections that by their nature should survive termination do.
Dispute resolution and arbitration
These terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. Except for claims that may be brought in small-claims court, you and ESA Verified agree to resolve disputes by binding individual arbitration administered by a recognized arbitration provider, and to waive any right to a jury trial or to participate in a class action. You may opt out of this arbitration agreement by emailing legal@esaverified.com within 30 days of first accepting these terms; opting out does not affect the other terms. Where this arbitration provision is unenforceable, disputes will be heard in the state or federal courts located in Delaware.
Changes
We may update these terms. If a change is material we will note it on the site and, where the change needs it, ask for your consent again. Continued use after a change means you accept the updated terms.
Miscellaneous
If a provision is unenforceable, the rest still applies. These terms and the policies they reference are the entire agreement between us about the service. You may not assign your rights; we may assign ours to a successor. Notices to you may be sent to your email on file.
