Is an emotional support animal letter confidential?

Answers

Treated as confidential, yes. Legally airtight, less so, which is an argument for giving less.

The expectation

Information obtained in connection with a reasonable accommodation request should be kept confidential and used only to evaluate the request. Disclosing it to other residents, or using it for any other purpose, is not something a provider can justify.

Why that is thinner protection than it sounds

Your landlord is not a healthcare provider, so the health privacy rules you may be thinking of do not bind them. The protection here comes from fair housing principles and from state law, which varies. The practical consequence: once information is in a management company file, your control over it is limited.

Which is why the letter should say so little

A properly written letter establishes two facts: that you have a disability within the meaning of the Fair Housing Act, and that the animal is needed because of it. It does not name your condition. That is not coyness, it is the correct scope, and it means the document in the file cannot leak something it never contained.

HOAs are the weak point

A board is a group of your neighbours, minutes get circulated, and a variance may be discussed at a meeting. Ask in writing that the request be handled confidentially and that any minute record the decision rather than the reasons. Supply the minimum.

Common questions

Can I ask them to delete it afterwards?
You can ask. Whether they must depends on state law and on their own retention policy, and most will keep the tenancy file for years.

Start an assessment

A clinician licensed in your state reviews it and decides. The fee is refunded if they decline to issue, because a review that cannot say no is not a review.
