Responding to a violation notice

Answers

A notice is the start of a process, not the end of one, and how you answer it shapes everything after.

Work out what it actually says

  • An unauthorised animal in a no-pets building. If you have never made an accommodation request, make one now, in writing, and say you are doing so.
  • Conduct: noise, mess, an animal loose in a corridor, damage. That is a tenancy matter and the accommodation does not answer it. Address the conduct directly.
  • Documentation: they say your paperwork is inadequate. Ask specifically what is wrong with it, because it is usually a missing licence number and that is fixable.

Respond in writing, quickly

Within a few days, even if only to acknowledge and say a full response follows. Silence reads as agreement with the allegation, and the gap between a notice and your reply is the part that looks bad later.

What to include

  • The date of any accommodation request you made, and whether it was answered.
  • A direct answer to the allegation, including where you accept part of it. Acknowledging a genuine problem and saying what you are doing about it is far stronger than denying everything.
  • Documentation, if the objection is about that.
  • A request for the evidence, where the allegation is a complaint you have not seen.

Do not stop paying rent, do not agree in writing to remove the animal in the first shaken hour, and do not argue with neighbours about it. All three make the file worse.

Common questions

Does a pending accommodation request stop the notice?
It does not halt anything automatically, and proceeding over an unanswered request is a serious problem for the provider. Say in writing that the request is outstanding.

Start an assessment

A clinician licensed in your state reviews it and decides. The fee is refunded if they decline to issue, because a review that cannot say no is not a review.
