Emotional support animals in corporate and temporary housing

Housing situations

The question is whether you are living there or staying there, and the line is less about length than people assume.

Dwelling or accommodation

The Fair Housing Act protects dwellings, meaning places occupied as a residence. A serviced flat taken for six months while you relocate is a residence and is covered. A room in an extended-stay hotel for a fortnight is much closer to a public accommodation under the ADA, which reaches trained service animals only.

What actually decides it

  • Whether you have a lease or a booking.
  • Whether it is your only residence for the period.
  • Whether the operator provides hotel-type services daily.
  • Length, which matters but is not decisive on its own. A month in a serviced flat you treat as home reads differently from a month of hotel nights.

When your employer arranged it

The housing provider owes the duty, not your employer, but the employer arranged the contract and usually has more leverage with the operator than you do. In a relocation, raising it with the relocation team before the booking is made is by far the easiest route, and it avoids having to argue the dwelling question at all.

Ask before booking, and get the answer in writing. Most operators have a policy and many will accommodate a documented animal without needing the legal question resolved.

Extended-stay hotels specifically

These are the hardest case, because they are literally hotels that people sometimes live in for months. A stay booked nightly, with housekeeping and no lease, looks like a public accommodation under the ADA, which reaches trained service animals only. A resident of eight months with a monthly rate and their post delivered there has a real argument that it has become a dwelling, and some courts have accepted exactly that.

What to do rather than argue it

  • Ask before booking, in writing, and get the answer in writing.
  • Where the operator has a pet policy, ask whether the fee is waived for an assistance animal rather than assuming either way.
  • If your employer is arranging it, raise it with them first. They are the customer and have leverage you do not.
  • Keep the booking terms. Whether it is a lease or a reservation is the question the whole analysis turns on.

Common questions

Is a three-month serviced flat covered?
Probably, if it is your residence for that period. The longer the stay and the more it functions as a home, the stronger the argument.

A clinician licensed in your state reviews it and decides. The fee is refunded if they decline to issue, because a review that cannot say no is not a review.
