Emotional support animals in subsidised and public housing

Housing situations

More law applies here, not less, and that is worth knowing given what happened to HUD enforcement in May 2026.

Three statutes instead of one

A federally assisted housing provider is subject to the Fair Housing Act, to Section 504 of the Rehabilitation Act because it receives federal financial assistance, and where it is a public entity to Title II of the ADA. Section 504 requires reasonable accommodation in federally assisted programmes, and it is a separate obligation with its own enforcement path.

That matters right now. HUD's May 2026 change was to how the Office of Fair Housing and Equal Opportunity handles Fair Housing Act animal complaints. It did not repeal Section 504, and a subsidised housing provider still has obligations that do not depend on that enforcement posture.

Housing choice vouchers

With a voucher you are renting from a private landlord, so the landlord's duty is the ordinary Fair Housing Act duty. The housing authority administering the voucher has its own obligations, and a landlord cannot refuse an accommodation by pointing at the authority, or the other way round.

Public housing specifically

  • Pet policies in public housing are set by statute and regulation as well as by the authority, and assistance animals sit outside them.
  • Pet deposits permitted for pets in public housing are not permitted for assistance animals in the same way, and this is one of the areas where the pre-2026 position has the most regulatory support behind it.
  • The grievance procedure is a real route and is usually faster than any complaint to an outside agency.

Common questions

Can public housing refuse an emotional support animal?
On the ordinary grounds only, and it has Section 504 obligations on top of the Fair Housing Act ones.
Does my voucher landlord have to accept it?
They have the same duty any private landlord has.
