Renewing an emotional support animal letter in North Dakota

North Dakota

Letters carry a term for a reason: they record a clinical opinion about your circumstances at a point in time, and circumstances move.

How long a letter lasts

Neither the Fair Housing Act nor North Dakota law fixes an expiry date, which surprises people. The 12-month term is a professional convention, and a well-founded one: a housing provider assessing reliability will discount a document written several years ago, and a clinician asked to stand behind a stale opinion generally will not.

What a renewal should involve

  • A fresh clinical view of whether the disability-related need still exists. This is the part that makes it a renewal rather than a reprint.
  • Confirmation that the clinician's licence is still current, since the letter states its expiration date and a housing provider can check it.
  • A new issue date and term.
  • The same ESA ID discipline, so a provider verifying it sees the current status rather than a cached one.

If your letter has already expired

An expired letter is not evidence of anything current, and a housing provider is entitled to say so. A granted accommodation does not automatically evaporate on the expiry date, but a provider reviewing your tenancy, or a new provider, will ask for something current, and you are on much weaker ground without it.

What North Dakota law says about it

North Dakota has its own fair housing statute, the North Dakota Housing Discrimination Act (N.D.C.C. ch. 14-02.5), enforced by the North Dakota Department of Labor and Human Rights. A state complaint runs on state law, so HUD changing its own enforcement priorities does not decide it.

North Dakota has no statute written specifically about emotional support animals. That is the ordinary position: only seven states have one. It means the question in North Dakota is decided by the North Dakota Housing Discrimination Act and by how a court reads the reasonable accommodation duty, not by a dedicated rule you can point a landlord at.

If you move

A letter is tied to the licence of the clinician who wrote it, not to your lease. Moving out of North Dakota does not void it, but a new housing provider is entitled to reliable documentation, and a clinician licensed only in North Dakota is a weaker answer to that question once you live somewhere else. North Dakota sits in the Midwest, and the rules next door are not the same.

Watch Iowa (30-day rule, Iowa Code § 216.8B, as amended by SF 2268 (2024)). Moving there means starting a clinical relationship well before you need the documentation, which is the opposite of how most people plan a move.

Illinois, Indiana, Kansas, Michigan, Minnesota run on the federal position plus their own fair housing statute, much as North Dakota does.

A North Dakota housing provider handed a letter has no register to check it against, which is the reason so much of this market is worthless paper. Every letter issued here carries a six digit ESA ID and a public verification page, so a landlord can confirm the letter is real, current, and issued by a licensed clinician without being shown a single word about anybody's health.

Common questions

Does my North Dakota landlord have to re-approve the animal every year?
A provider should not put you through the whole process again for an accommodation already granted and working. They can reasonably ask for current documentation where the original has lapsed.
Can I renew with a different clinician?
Yes. A new clinician will want to evaluate you themselves rather than take the previous letter at face value.
How early should I renew?
Inside the last sixty days. That leaves room for the review and avoids a gap, which is the moment a provider is most likely to raise the question.
