Do emotional support animal letters expire?
Answers
Not by law. By convention, and for a reason that makes sense once you see it.
Nothing in law says twelve months
Neither the Fair Housing Act nor any state statute sets a term for assistance animal documentation. People are often surprised by this, because every letter they have seen carries one.
Why the convention exists anyway
Because the document records a clinical opinion about your circumstances at a moment in time, and circumstances move. A housing provider assessing whether documentation is reliable will discount something written four years ago, and a clinician asked whether an old opinion still holds will generally say they would need to see you. Twelve months is the point at which both of those remain comfortable.
What a provider does with an old letter
- For an accommodation already granted and working: usually nothing.
- For a new tenancy: asks for something current, reasonably.
- Where the licence stated on it has since expired: treats it as unreliable, which is fair, since the licence expiry date is printed precisely so it can be checked.
The practical rule
Keep it current if you rent, expect to move, or expect your building to change hands. If you own your home and the only audience is an HOA that granted the accommodation years ago, the pressure is much lower.
Common questions
- Can a landlord require annual renewal?
- They can ask for current documentation where the original has lapsed. Running the full process every year for a settled accommodation is much harder to justify.
