What happens when your letter expires

Answers

Less than people fear if you are staying put, and more than they expect if you are moving.

If you are staying where you are

An accommodation that has been granted does not evaporate on the expiry date. The animal has lived there, the arrangement works, and a provider re-opening a settled accommodation because a date passed is doing something they would struggle to justify. In practice most providers never look again.

When it starts to matter

  • You move, and a new provider asks for documentation. An expired letter is not evidence of anything current.
  • The building changes hands or gets a new manager, and the file is reviewed.
  • A complaint is made about the animal, and the documentation is examined as part of it.
  • You are applying for a new tenancy, where the documentation is part of what is being assessed.

Expired is not the same as invalid

No statute sets an expiry date for these documents at all. The twelve month term is a professional convention, which means an expired letter is better understood as a stale clinical opinion than as a void document. It still shows a clinician reached a view; it just shows they reached it a while ago.

Renewing after a gap

Straightforward in most states. In Arkansas, California, Iowa, Louisiana and Montana the thirty day relationship requirement applies to the new documentation, so if you have changed clinician the clock starts again. That is the argument for renewing with whoever knows you.

Common questions

Can my landlord evict me because my letter expired?
Not on that alone, for an accommodation already granted and working. They can reasonably ask for something current.

Start an assessment

A clinician licensed in your state reviews it and decides. The fee is refunded if they decline to issue, because a review that cannot say no is not a review.
