Are online emotional support animal letters legal in Arkansas?
Arkansas
The delivery method was never the issue in Arkansas. The 30-day rule is.
The short answer
Online is not the problem in Arkansas. Speed is. A.C.A. § 20-14-1003 requires the client-provider relationship to predate the documentation by 30 days, and that applies whether the clinician is down the road or on a screen.
The statute carves out an exception for a person verified as homeless. Otherwise the relationship has to predate the documentation by thirty days, which no same-day online letter can satisfy.
So a Arkansas letter bought online and delivered within the hour is not lawful documentation. It is not a grey area and it does not depend on how the letter is worded.
How to tell the difference
- Does it name a clinician, with a licence type, number and issuing state you can check against the board? A letter that does not is not going to survive scrutiny.
- Is the clinician licensed in Arkansas? A licence from elsewhere does not carry.
- Can the answer be no? A guarantee of approval is a guarantee that nobody is deciding.
- Is it selling a registration, certificate or ID alongside the letter? Those have no legal effect, and California requires sellers to say so in writing.
- Does the timeline actually allow 30 days? In Arkansas this is the question that decides it.
The Arkansas legal position
Arkansas has a fair housing statute of its own, the Arkansas Civil Rights Act (Ark. Code § 16-123-201 et seq.), but not a state enforcement agency that HUD recognises as substantially equivalent. So the statute exists to be sued on rather than complained to, and the administrative route runs through HUD Region VI (Fort Worth). After May 2026 that distinction bites: the administrative route is the one that narrowed, and in Arkansas it is the only one there is.
Arkansas also legislated on emotional support animals directly, which most states have not. These are the sections that matter:
- A.C.A. § 20-14-1001: Defines an emotional support animal as one providing emotional, cognitive or similar support, and expressly does not require the animal to be trained or certified.
- A.C.A. § 20-14-1003: Sets what a provider must do before issuing emotional support animal documentation, including a client-provider relationship of at least thirty days.
- A.C.A. § 20-14-1004: Imposes escalating civil penalties for fraudulently representing an animal as an emotional support animal, or for failing to give a required notification.
- A.C.A. § 20-14-1005: Permits a private property owner to prohibit emotional support animals, and limits that owner's liability except in cases of gross negligence.
What a housing provider will actually do
A Arkansas housing provider handed a letter has no register to check it against, which is the reason so much of this market is worthless paper. Every letter issued here carries a six digit ESA ID and a public verification page, so a landlord can confirm the letter is real, current, and issued by a licensed clinician without being shown a single word about anybody's health.
Common questions
- Are online ESA registrations valid in Arkansas?
- No, and not anywhere else either. There is no federal or state register of emotional support animals, so nothing can put you on one. California legislated specifically to require sellers of these products to disclose that in writing.
- Will a Arkansas landlord accept a telehealth letter?
- They are entitled to test it against A.C.A. § 20-14-1003. A telehealth letter from a relationship of at least 30 days with a Arkansas-licensed clinician is documentation. One issued the same day is not.
- What happens if a landlord decides my letter is fake?
- They can refuse the accommodation on reliability grounds, and you would be arguing about it afterwards rather than living with your animal in the meantime. In Arkansas, knowingly supplying false documentation also carries a penalty under A.C.A. § 20-14-1004.
