Emotional support animals and grief

By condition

The page most likely to tell you no, and the one where saying so plainly matters most.

Grief is not a disability

Ordinary grief, however severe, is not an impairment within the meaning of the Fair Housing Act. It is a normal response to loss, it is expected to change over time, and a clinician who issues a letter on the strength of a recent bereavement alone is not applying the standard. We would rather say that here than take the fee and decline.

A diagnosis is not the test and does not decide this. The question is whether the impairment substantially limits a major life activity, and whether this animal alleviates a symptom or effect of it. Both halves have to hold, a licensed clinician decides, and the answer can be no.

When it becomes a different question

Sometimes grief precipitates or unmasks something that does meet the standard: a major depressive episode, an anxiety disorder, or prolonged grief disorder, which is recognised clinically and is not the same thing as grieving. Where that has happened the assessment is about that impairment, and it may well be a strong case. The distinction is clinical and it is exactly what an evaluation is for.

If the timing is the problem

If you have recently lost someone and are facing a housing situation that threatens an animal you already have, the honest advice is that the accommodation route may not be the fastest one. A conversation with the housing provider, or help from a local tenants service, sometimes resolves it quicker than documentation that may not issue.

If you are thinking about harming yourself, call or text 988 in the United States to reach the Suicide and Crisis Lifeline. It is free and available at any hour. An assessment on this site is not a crisis service and is not a substitute for one.

Common questions

Can I get an ESA letter because my partner died?
Not on the bereavement itself. If it has led to an impairment that substantially limits a major life activity, that is a different assessment and may well support one.
What if a service tells me I qualify?
That is a service that does not decline anybody, which tells you what its documentation is worth to a housing provider.

Start an assessment

A clinician licensed in your state reviews it and decides. The fee is refunded if they decline to issue, because a review that cannot say no is not a review.
