Emotional support animals in Section 202 and 811 housing

Housing situations

The strongest legal position of any housing type, and the one least affected by what HUD did in May 2026.

What these programmes are

Section 202 funds supportive housing for elderly residents; Section 811 funds supportive housing for people with disabilities. Both are federally assisted, and both exist specifically to house people the accommodation duty was written for.

Why the position here is strong

  • The Fair Housing Act applies, as it does everywhere.
  • Section 504 of the Rehabilitation Act applies because the provider receives federal financial assistance. That is a separate statutory obligation with its own enforcement path.
  • Where the provider is a public entity, Title II of the ADA applies as well.
  • Federal housing pet rules are set by regulation, and assistance animals sit outside them by design rather than by argument.

HUD narrowed its Fair Housing Act enforcement posture on animals in May 2026. It did not repeal Section 504, and a Section 811 provider still has obligations that do not depend on the enforcement posture that changed. Any provider treating the rescission as a general permission has misread it.

The practical route

Most of these providers have a formal grievance procedure, and it is usually faster than any outside complaint. Use it, in writing, before escalating. There is frequently also a service coordinator whose job includes exactly this.

The service coordinator

Section 202 and 811 properties commonly have a service coordinator whose role includes helping residents access what they are entitled to. They are frequently the fastest route to an accommodation, they know the management company, and they deal with 504 obligations routinely. Start there before escalating anywhere.

Where these properties get it wrong

  • Applying the federal pet rules to an assistance animal. Those rules deal with pets, and assistance animals sit outside them by regulation.
  • Requiring a pet deposit that the pet rules permit for pets, on an animal that is not one.
  • Treating the May 2026 HUD change as applying to Section 504, which it did not.
  • Asking for a diagnosis, which is no more permitted here than anywhere else.

Common questions

Can a 202 property charge a pet deposit for an assistance animal?
This is one of the areas where the pre-2026 position has the most regulatory support behind it, because federal housing pet rules deal with assistance animals separately by regulation rather than by rescinded guidance.
