Telehealth and emotional support animal letters
How it works
A legitimate route, governed by the same licensure rules as any other telehealth encounter.
The rule that governs it
Telehealth is regulated by the state where the patient is located, not where the clinician sits. A clinician treating you by video in your state is practising in your state and needs to be licensed there. That is the same rule that applies to any other telehealth encounter, and it is why the licence state question keeps coming back.
What a real telehealth evaluation looks like
- An intake that asks about symptoms, duration, functional impact and the animal's role, rather than only your details.
- A clinician who can ask follow-up questions and who could reach a different conclusion than the one you want.
- Documentation identifying that clinician and their licence.
- A record that the encounter happened, which is what makes it a clinical relationship rather than a transaction.
Where states add requirements
Iowa expressly allows the required thirty day relationship to have been conducted by telemedicine. Louisiana allows its two evaluation sessions to be remote but excludes online letter services from the definition of a therapeutic relationship. California requires a California licence and thirty days. The pattern is that states are regulating the relationship, not the medium.
Interstate compacts, and why they matter here
Several professions now operate interstate licensure compacts, which let a clinician practise across member states without holding a separate licence in each. Where a compact covers your state and your clinician participates, an out-of-state clinician may be lawfully practising in your state, which changes the licence analysis. This is the one genuine exception to the rule that the clinician must hold a licence in your state, and it is worth asking about rather than assuming either way.
Records
A telehealth encounter creates a clinical record like any other, and in the five relationship-rule states that record is what establishes the relationship existed for the required period. A service that keeps no record has nothing to point at when a housing provider pushes, which is a practical reason to prefer one that does.
Common questions
- Is a telehealth ESA letter legal?
- Yes, where the clinician is licensed in your state and actually evaluated you.
- Can a clinician in another state see me by video?
- For this purpose that is the problem, not the solution. Documentation needs to come from someone licensed where you are.
