Emotional support animal housing law in Louisiana

Louisiana

Where protection in Louisiana actually comes from now that the federal enforcement position has narrowed, and who to complain to when it is ignored.

The federal position, as of 2026

On 22 May 2026 HUD permanently rescinded its 2020 assistance animal notice and narrowed its own enforcement to animals individually trained to do work or perform tasks for a person with a disability. That is the Americans with Disabilities Act service animal test, and an emotional support animal does not meet it. A complaint to HUD about a refused emotional support animal is now unlikely to produce a finding of reasonable cause.

What survived:

  • The Fair Housing Act itself is unchanged. Congress wrote the statute and HUD only changed how it enforces it, so the statutory duty to make reasonable accommodations for people with disabilities still stands.
  • The private right of action is unchanged. A tenant can still sue in state or federal court, and a court interpreting the statute is not bound by an agency's enforcement posture.
  • State law is untouched. HUD has no authority over a state statute, and this is where the protection now mostly lives.

Louisiana law

Louisiana has its own fair housing statute, the Louisiana Equal Housing Opportunity Act (La. R.S. § 51:2606), enforced by the Louisiana Commission on Human Rights. A state complaint runs on state law, so HUD changing its own enforcement priorities does not decide it.

Louisiana also legislated on emotional support animals directly, which most states have not. These are the sections that matter:

  • La. R.S. §§ 46:1971 to 46:1978: The Louisiana Support and Service Animal Integrity Act, enacted as Act 558 of 2024 and effective 1 August 2024, which sets out what a housing provider may request and what a provider must do before issuing support animal documentation.
  • La. R.S. § 46:1974: Requires a therapeutic relationship of at least thirty days and at least two evaluation sessions, in person or remote, before a licensed provider may issue documentation.
  • La. R.S. § 46:1975: Penalises misrepresenting an animal as a service or support animal.

The 30-day rule in Louisiana

Louisiana requires the client-provider relationship to exist for at least 30 days before emotional support animal documentation is issued (La. R.S. § 46:1974, enacted by Act 558 of 2024). A letter produced the same day you fill in a questionnaire does not satisfy it, no matter who signs it or what it costs.

Louisiana goes further than the other thirty-day states. It requires two evaluation sessions as well as the thirty days, and the statute expressly writes online letter services out of the definition of a therapeutic relationship. A single questionnaire cannot satisfy it however it is worded.

This is the single most important thing to know before paying anyone for a Louisiana letter, and it is the thing online letter services are least likely to tell you. A document that does not meet La. R.S. § 46:1974, enacted by Act 558 of 2024 is not documentation a housing provider has to treat as reliable, so the money buys nothing.

What a housing provider may ask for

  • Where the disability is not obvious, reliable documentation of the disability and of the disability-related need for the animal.
  • Nothing about the nature or severity of the condition, no diagnosis, and no medical records.
  • No certification, licence, training or registration for the animal, because none of those exist for an emotional support animal.
  • No breed, weight or size restriction applied as though the animal were a pet, where the accommodation is granted.

Grounds a provider can still rely on

  • The specific animal poses a direct threat to the health or safety of others that cannot be reduced by another reasonable accommodation. This has to be about the actual animal and its actual conduct, not about a breed.
  • The animal would cause substantial physical damage to property.
  • The accommodation would impose an undue financial and administrative burden, or fundamentally alter the provider's operations.
  • The documentation is not reliable.

Misrepresentation in Louisiana

Louisiana penalises misrepresentation and, unusually, the statute reaches emotional support animals rather than only service animals. Under La. R.S. §§ 46:1971 to 46:1978: $500 for a first violation, $1,000 for a second, and $2,500 for a third or later violation.

If you move

A letter is tied to the licence of the clinician who wrote it, not to your lease. Moving out of Louisiana does not void it, but a new housing provider is entitled to reliable documentation, and a clinician licensed only in Louisiana is a weaker answer to that question once you live somewhere else. Louisiana sits in the South Central, and the rules next door are not the same.

Watch Arkansas (30-day rule, A.C.A. § 20-14-1003). Moving there means starting a clinical relationship well before you need the documentation, which is the opposite of how most people plan a move.

Oklahoma, Texas run on the federal position plus their own fair housing statute, much as Louisiana does.

Where a complaint goes

To the Louisiana Commission on Human Rights, under the Louisiana Equal Housing Opportunity Act (La. R.S. § 51:2606). A state complaint is decided on state law, which is why it matters more now than it did before May 2026.

A Louisiana housing provider handed a letter has no register to check it against, which is the reason so much of this market is worthless paper. Every letter issued here carries a six digit ESA ID and a public verification page, so a landlord can confirm the letter is real, current, and issued by a licensed clinician without being shown a single word about anybody's health.

Common questions

Does a no-pets policy in Louisiana apply to an emotional support animal?
A granted accommodation is an exception to the pet policy, because the animal is not being kept as a pet. What changed in 2026 is how readily a federal agency will enforce that view, not the underlying reasonable accommodation duty.
How long does a Louisiana landlord have to respond?
There is no single federal deadline; the duty is to respond promptly, and an unexplained delay can itself be treated as a constructive denial. Virginia is unusual in writing a timeline into its statute.
Can I be evicted over an emotional support animal in Louisiana?
Over the animal's conduct, yes: an animal that damages property or threatens people is not protected by the accommodation. Over the existence of a properly documented assistance animal, that is what the fair housing statute exists to prevent.

Starting the 30 days in Louisiana

The clock only runs forward, so the useful thing to do today is begin the assessment rather than wait until the letter is needed. A clinician licensed in Louisiana reviews it, and the fee is refunded if they decline.
