Are online emotional support animal letters legal in Louisiana?

Louisiana

The delivery method was never the issue in Louisiana. The 30-day rule is.

The short answer

Online is not the problem in Louisiana. Speed is. La. R.S. § 46:1974, enacted by Act 558 of 2024 requires the client-provider relationship to predate the documentation by 30 days, and that applies whether the clinician is down the road or on a screen.

Louisiana goes further than the other thirty-day states. It requires two evaluation sessions as well as the thirty days, and the statute expressly writes online letter services out of the definition of a therapeutic relationship. A single questionnaire cannot satisfy it however it is worded.

So a Louisiana letter bought online and delivered within the hour is not lawful documentation. It is not a grey area and it does not depend on how the letter is worded.

How to tell the difference

  • Does it name a clinician, with a licence type, number and issuing state you can check against the board? A letter that does not is not going to survive scrutiny.
  • Is the clinician licensed in Louisiana? A licence from elsewhere does not carry.
  • Can the answer be no? A guarantee of approval is a guarantee that nobody is deciding.
  • Is it selling a registration, certificate or ID alongside the letter? Those have no legal effect, and California requires sellers to say so in writing.
  • Does the timeline actually allow 30 days? In Louisiana this is the question that decides it.

The Louisiana legal position

Louisiana has its own fair housing statute, the Louisiana Equal Housing Opportunity Act (La. R.S. § 51:2606), enforced by the Louisiana Commission on Human Rights. A state complaint runs on state law, so HUD changing its own enforcement priorities does not decide it.

Louisiana also legislated on emotional support animals directly, which most states have not. These are the sections that matter:

  • La. R.S. §§ 46:1971 to 46:1978: The Louisiana Support and Service Animal Integrity Act, enacted as Act 558 of 2024 and effective 1 August 2024, which sets out what a housing provider may request and what a provider must do before issuing support animal documentation.
  • La. R.S. § 46:1974: Requires a therapeutic relationship of at least thirty days and at least two evaluation sessions, in person or remote, before a licensed provider may issue documentation.
  • La. R.S. § 46:1975: Penalises misrepresenting an animal as a service or support animal.

What a housing provider will actually do

A Louisiana housing provider handed a letter has no register to check it against, which is the reason so much of this market is worthless paper. Every letter issued here carries a six digit ESA ID and a public verification page, so a landlord can confirm the letter is real, current, and issued by a licensed clinician without being shown a single word about anybody's health.

Common questions

Are online ESA registrations valid in Louisiana?
No, and not anywhere else either. There is no federal or state register of emotional support animals, so nothing can put you on one. California legislated specifically to require sellers of these products to disclose that in writing.
Will a Louisiana landlord accept a telehealth letter?
They are entitled to test it against La. R.S. § 46:1974, enacted by Act 558 of 2024. A telehealth letter from a relationship of at least 30 days with a Louisiana-licensed clinician is documentation. One issued the same day is not.
What happens if a landlord decides my letter is fake?
They can refuse the accommodation on reliability grounds, and you would be arguing about it afterwards rather than living with your animal in the meantime. In Louisiana, knowingly supplying false documentation also carries a penalty under La. R.S. §§ 46:1971 to 46:1978.

Starting the 30 days in Louisiana

The clock only runs forward, so the useful thing to do today is begin the assessment rather than wait until the letter is needed. A clinician licensed in Louisiana reviews it, and the fee is refunded if they decline.
